In July 2023, the Ombudsman Commission received a complaint from a Managing Director of a construction company.
According to the managing director, the construction company was contracted by a government department to execute maintenance works for a district feeder road.
Upon completion of the road maintenance works in 2016, the government department did not fulfil its obligation to pay the outstanding amount of K805,454.28 owed to the construction company. The government department had only paid K100,000.00 in June 2020 which amounted to a breach of its contractual obligation.
The Commission commenced an investigation and necessary referrals with the government department responsible. As a result of the Commission’s intervention, the outstanding amount of K805 454.28 was paid to the construction company.
The Commission confirmed that the government department responsible had settled the K805 454.28 outstanding in three (3) instalment payments. An initial payment of K100 000.00 was made in June 2020, followed by the two (2) additional instalments of K462,727.28 and K352,727.28 on the 20 of September 2023 and 25 of October 2023.
